1. Definitions

Client: Any individual or entity engaging our landscaping services.
Services: All landscaping services provided by Landscapers Battersea.
Agreement: The contract formed between the Client and Landscapers Battersea.

2. Services Provided

We offer a range of landscaping services including, but not limited to:

Garden design and planning
Lawn maintenance
Planting and tree care
Hardscaping and patio installation
Water feature installation

2.1 Customization

All services are tailored to meet the specific needs and preferences of our Clients. We ensure that each project is unique and reflects the vision of the Client.

3. Client Responsibilities

The Client agrees to:

Provide accurate information related to the project.
Ensure access to the property during the agreed-upon schedule.
Make timely payments as per the payment schedule.

4. Payment Terms

Payment for services rendered by Landscapers Battersea is due as follows:

A deposit of 30% is required upon acceptance of the proposal.
The remaining balance is due upon completion of the project.
Payments can be made via bank transfer, cheque, or other agreed-upon methods.

Late payments may incur additional charges. It is the Client's responsibility to ensure payments are made promptly.

5. Project Timeline

We strive to complete all projects within the agreed timeframe. However, unforeseen circumstances such as weather conditions or supply delays may affect the schedule. Landscapers Battersea will communicate any changes to the Client as soon as possible.

5.1 Delays

In the event of delays, the Client has the right to terminate the agreement with a full refund of any deposit paid if the delay exceeds two weeks beyond the original completion date.

6. Changes and Revisions

If the Client requests changes to the initial project scope, these may incur additional costs. All changes must be documented in writing and approved by both parties before implementation.

7. Cancellation Policy

The Client may cancel the agreement under the following conditions:

Cancellation within 7 days of signing the agreement will result in a full refund of the deposit.
Cancellations after 7 days but before project commencement will incur a 50% cancellation fee.
No refunds will be provided once the project has commenced.

8. Liability

Landscapers Battersea is committed to providing quality services. However, we are not liable for:

Damage due to natural disasters.
Pre-existing conditions on the property.
Delays caused by third-party suppliers or contractors.

Our liability is limited to the total amount paid by the Client for the services provided.

9. Insurance

We maintain adequate insurance coverage to protect against potential damages or accidents that may occur during the execution of our services. Clients are advised to confirm their own insurance policies to cover personal property.

10. Intellectual Property

All designs, plans, and materials created by Landscapers Battersea remain the property of the company. Clients may not reproduce or distribute any materials without prior written consent.

11. Dispute Resolution

In the event of any disputes arising from these Terms and Conditions, both parties agree to seek resolution through mediation before pursuing legal action.

12. Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction in which Landscapers Battersea operates. Any legal actions will be conducted in the appropriate courts of this jurisdiction.

13. Amendments

Landscapers Battersea reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Client and Landscapers Battersea, superseding all prior agreements or understandings.
